Vâlceanul Dumitru Popescu, arestat fără mandat în America. Agenţii NMSD şi DHS au comis abuzuri grosolane

Ce să ne mai mire la procurorii din România când până şi oamenii legii din Statele Unite ale Americii comit abuzuri grosolane?! Cel puţin asta reiese din mai multe documente transmise de Arca Space Coropration, după reţinerea şi eliberarea vâlceanului Dumitru Popescu.

Din document – care clarifică subiectul pe care l-am abordat, în premieră, anul trecut – reiese că agenţii din New Mexico, Las Cruces, au interpretat în stil propriu şi eronat legea, pentru a-l scoate din peisaj pe Dumitru Popescu, CEO la Arca Space Corporation. Astfel, tărâmul făgăduinţei a devenit teren de vânătoare, ţinta fiind chiar inventatorul român, participant la 10 misiuni aerospaţiale, dintre care una pe Marte.

NMSD şi DHS au făcut o obsesie pentru construirea unui caz împotriva lui Dumitru Popescu, deşi FBI a refuzat să se implice. Scandalul nu a început pentru că s-ar fi plâns investitorii, ci din cauza celei de-a doua foste soţii a lui Popescu, care s-a dus la NMSD şi ar fi făcut în faţa investigatorilor mai multe declaraţii false. Printre altele, ea le-a spus acestora că românul ar fi plănuit să ia proprietăţile companiei, banii şi să fugă din America. În loc să stea de vorbă cu cel acuzat şi să asculte şi versiunea lui, total neinspiraţi, agenţii NMSD şi DHS au început să contacteze foştii angajaţi şi colaboratori ai ARCA, încercând să obţină mărturii împotriva inventatorului şi a proiectelor dezvoltate de acesta. Spre finele anului trecut, deşi nu aveau niciun element concludent, agenţii l-au arestat pe Dumitru Popescu, fără a avea un mandat. Acest lucru l-a uluit inclusiv pe judecătorul care a analizat cauza şi care, în cele din urmă, l-a eliberat pe CEO-ul companiei Arca. Din documentele pe care le-am primit zilele acestea de peste ocean, reiese şi faptul că agentul NMSD, deghizat ca investitor cu handicap, l-ar fi înregistrat pe Popescu și l-ar fi întrebat dacă are contracte cu Guvernul SUA. Răspunsul a fost: „Da, pentru ArcaBoard, cu Departamentul Apărării”. Numai că investigatorul a interpretat greșit înregistrarea audio şi l-a acuzat pe Popescu că ar fi declarat existența a 3 contracte, cu Marina Militară, Forțele Aeriene și cu Armata. Agentul NMSD l-a mai acuzat pe președintele ARCA că ar fi mințit în privinţa colaborărilor cu NASA, deşi firma era partener cu NASA Kennedy, Ames, Johnson, Stennis și Marshall Space Centers pentru programul ACO. O altă acuzaţie care nu a stat în picioare a fost şi aceea că ArcaBoard și drona Defiant nu ar zbura. De asemenea, extrasele bancare au demonstrat că Popescu nu a retras niciodată 42.000 de dolari cash din cont, cum se preciza în acuzare. „Agentul DHS i-a spus lui Dumitru Popescu, în fața martorilor – „Ești al meu”, „Te dețin”, „Nu exiști”, „Nu îți este permis să vorbești”, iar la telefon i-a transmis – „Nu contează ce zic avocații tăi, legea e lege…nu ai dreptul la un permis de muncă în US, pentru că nu exiști”. De faţă cu alte persoane, acelaşi agent DHS l-a ameninţat pe reprezentantul ARCA şi i-a comunicat că i-a anulat contractul cu DARPA pentru tehnologia ArcaBorad. Şirul abuzurilor a continuat pe holurile Tribunalului, unde agentul DHS a încercat să o intimideze pe Simona Popescu, unul dintre acţionarii semnificativi ai ARCA. Aceasta venise să-l susţină pe preşedintele companiei, iar investigatorul a ameninţat-o că o arestează şi că tot ceea ce ţine de ARCA va zbura din SUA”, se mai arată în comunicatul intitulat „Civil Rights Violations Against Aerospace CEO and His Company”.

După eliberarea vâlceanului din închisoare, înaintea sărbătorilor de la finele anului 2017, acelaşi agent DHS l-a sfătuit pe acesta să-i vândă ARCA lui Michael Persico. Mai mult, la cinci luni de la arestul oficial, din 24 octombrie 2017, reprezentanţii statului amercian nu sunt încă pregătiţi să-şi susțină acuzațiile şi caută şi la ora actuală dovezi împotriva lui Dumitru Popescu, al cărui caz se mişcă în viteza melcului. Din dorinţa aparent nebună de a-l „anihila” pe român, investigatorii i-au propus diverse înţelegeri. La început, i-au transmis prin avocat să restituie 1 milion de dolari. Fiind refuzaţi, şi-au redus pretenţiile la 74.000 de dolari şi 3 ani de încercare, dar CEO-ul ARCA nu a acceptat, considerându-se nevinovat şi fiind convins că, în cele din urmă, Justiţia va fi de partea sa. Între timp, Popescu a avut discuţii şi cu FBI, care, studiind situaţia, nu l-a acuzat de nimic. Cu toate acestea, „odiseea americană horror” a vâlceanului, în SUA, continuă.

Civil Rights Violations Against Aerospace CEO and His Company

State institutions make their own law in New Mexico, Las Cruces, in the case of Dumitru Popescu, CEO of ARCA Space Corporation. The promised land for the private space development Las Cruces – New Mexico, became the land of hunting the CEO of a company with ten aerospace missions and one mission involving Mars, in the background. New Mexico Securities Division (NMSD) and Department of Homeland Securities (DHS) Las Cruces, New Mexico decided to build a case against Popescu when FBI refused to pursue a case.

On October 24th, 2017, when Dumitru Popescu (ARCA Space CEO) was returning from a trip from Europe to the US, he was arrested when he landed in the Atlanta airport. At that point, ARCA was only a couple of weeks from starting the tests of an advanced Aerospike Rocket Engine at Spaceport America.

The case initially started not from complaints from investors, but because Dumitru Popescu’s second former wife with whom he was married for only 6 months, between 2016 through 2017, went to the NMSD and told the investigators a number of false statements, such as that he was planning to take ARCA property, money and leave the US.

NMSD and DHS agents decided not to come talk to Popescu for any clarifications prior to filing charges but they started calling former ARCA employees, investors and institutions, instigating witnesses to say something bad about Popescu and his projects.

After that, a series of very dangerous facts occurred with Popescu and his company:

– His arrest was done without a warrant, the DHS and NMSD agents performing potential false arrest. After almost five months, the State and the lawyers never could provide to Popescu the warrant. Once, the prosecutor told the Judge in court, looking through his documents, that he can’t find the arrest warrant and it should be in there, in spite of not having a warrant at all.

– Even if FBI refused to not pursue a case against Popescu, NMSD and DHS La Cruces created their case in the spirit of their own law

– Michael Persico, a questionable ARCA business partner plotted with the local authorities against the company

– NMSD agents fabricated false charges like: ARCA aerospace products don’t work (in spite of having evidence of the contrary from their own investigation with ARCA engineers), ARCA CEO took cash money (in spite of having acces to bank accounts which showed the contrary);

– DHS agents abused their power telling Popescu that “I canceled your DARPA contract” for the ArcaBoard technology (ARCA won a DARPA contract for this aerospace technology);

– DHS agents intimidate Popescu relatives and shareholders in front of witnesses, telling them: “I will arrest you if you go to ARCA, do you understand me?… ARCA, doesn’t exists, never existed. ARCA and Popescu will be out of the US forever”, “You are mine”, “I own you”, “You don’t exist”, “You are not allowed to speak” 2

 

– NMSD and DHSagents disclosed and plotted a plan with Michael Persico, CEO Of Anova Technologies and ex-ARCA Director of the Board, to have Popescu arrested and deported prior to placing any official charges :

“No we’re going to try to get him deported at some point, but we want him to serve some jail time.” We might take them into custody first and then get them indicted with the State. And if he gets a bond then we take him back into custody and see where it goes. I think we can keep him in custody according to our attorneys.”

– DHS agents expressed racial and prejudicial biases to Poepscu’s former wife that Popescu and his family “Sounds like Gypsies”,

– DHS agents requested to witnesses, Popescu private property without have a warrant

– NMSD transcribed a false charge after going undercover at a ARCA public presentation

– DHS agents told Popescu to sell his company to Michael (the investor, and former Director of the Board)

The prosecutor verbally transmitted to Popescu’s lawyer that if he makes restitution in the range of around $1 million his case will be settled, despite all charges combined, if found guilty of all, only represented a fraction of this amount.

After Popescu submitted just part of the exculpatory evidence, the prosecutor immediately sent an official deal to his lawyer, indicating that the amount dropped to around $74,000 and 3 years’ probation but once again repeated what was originally indicated as the intention of the investigators, that he wants to throw Popescu out of New Mexico. Popescu rejected the deal, as he considers himself completely innocent. The parties involved appear to be exploiting the situation of an immigration matter that was in transition where Mr. Popescu did not have adequate time to adjust his legal status. Despite him having prior achievements such as the ability to design, prototype and launch aerospace products such as various rockets and the ArcaBoard, a product that was awarded a DARPA contract, a prestigious achievement among others, the agent rushed to file frivolous charges, suspended his visa, blocked him from the ability of adjusting his immigration status, and is now using this situation against him.

Five months have passed since the agent from DHS secluded Dumitru Popescu from his family, after harassing family members when they visited and left the US, the situation preventing him from earning income in the USA or interacting with his company. This situation could not continue without speaking out.

Mr. Benjamin Schrope, the same person that is the director of NMSD and approved his agent to press a number of false charges against Popescu, is also the prosecutor, an unethical arrangement and clear conflict of interest to his ability to carry out an impartial legal process.

This along with additional facts revealed that the legal process appears to have been undermined from the beginning, due to the fact he knowingly approved false charges, or charges without sustaining evidence, and overlooked rights violations performed by the agents and due to the fact the prosecutor demanded Popescu should leave New Mexico as part of a plea bargain deal, an immigration related punishment outside the scope of a securities investigation, an attempt to circumvent the legal process. Popescu does not believe he has been receiving a fair process and cannot receive a fair process under these circumstances, and considers it is his duty and right to disclose these matters.

Popescu is also calling on the support of any civil rights attorneys that are willing to help him deal with this situation.

Popescu thinks that this situation could not continue, and the authorities already alerted, such as the FBI, US Attorney, United Nations, The European Commission, civil society, 3

 

and any other parties of interest, must look into this and see if what is presented constitutes violations or not.
